Authorization
As the Client, you are authorizing Uniquehorn Designs to install any scripts, software or programs relevant to
the web design project and to access your account via either your hosting service panel or external FTP. Client
agree to provide Uniquehorn Designs with the login information and passwords necessary to access your website.
Uniquehorn Designs will maintain strict confidentiality of any login information and passwords and will not use
such for any purposes not specifically related to the contracted work.

Revisions
A revision is a minor change request, such as changing a font, pattern, or colors. A major change (such as requesting
a different layout than the one selected in the initial questionnaire or discussions) is not a revision. That is a
completely new design and requires placing a new order.

Up to 3 rounds of revisions are included free with every order.

Once a design has been approved and installed on the client’s site, the design is considered approved and completed.
Any additional design changes requested after installation will incur new fees.

Copyright & Credits
Any images and coding used in a custom site design are protected under a Creative Commons Copyright. All Clients
must maintain credits on the blog that link back to Uniquehorn Designs. Uniquehorn Designs requires the design to
be maintained as it was installed. The design and coding are subject to copyright and licensed to Client sole for use
as created. Designs are not covered under a Work for Hire agreement, unless entered into separately. Any alterations
made to the design are prohibited. All elements designed by Uniquehorn Designs and code created or edited by
Uniquehorn Designs must be removed immediately by resetting the site to a basic template if it is determined that
the Client or a third party hired by Client. Coping or editing any code designed and edited Uniquehorn Designs is
strictly prohibited.

Client guarantee to that any elements of text, graphics, photos, designs, trademarks, or other artwork provided to
Uniquehorn Designs by Client for inclusion in the web site are either owned by Client, or Client has permission for
use.

Logo Designs
Uniquehorn Designs will assign all rights to word designated as a Logo Design. Logo designs are not part of any
site design, unless specifically stated. Assignment of rights will occur only after full payment has been received
and cleared. Logo design is not a ‘Work For Hire’ unless agreed to in writing prior to project start. Logo design,
including but not limited to the artwork and coding, is not covered by Creative Commons Copyright.

Payment & Fees
All design services require a deposit before the project is placed in the queue. All payments are non-refundable
upon receipt. Final design products will not be released to the client or installed on the Client’s website before final
payment has been received and cleared. Payments are accepted via Paypal ONLY unless prior arrangements are
made with and approved by Uniquehorn Designs.

Communication
Once payment has been received and the design of your website has commenced, the Client must be available via
e-mail, able to answer all questions and complete tasks throughout the design process. Almost all communication
is via e-mail and/or Skype and not by phone, fax, postal mail or in person. This process often requires many quick
back and forth communications. The quicker we can communicate, the quicker we can get your new design finished
and installed.

Privacy Policy
All projects and Client information is maintained under strict confidentiality. Unless otherwise provided, Client
grants Uniquehorn Designs permission to include their name and link to Client’s page on portfolio pages.

Confidentiality
All correspondence and documents provided will be treated as confidential between the client and Uniquehorn
Designs. Uniquehorn Designs may maintain information indefinitely.

Project Consideration
Uniquehorn Designs reserves the right to refuse to design for any site with adult content or any other content it
deems objectionable. Uniquehorn Designs will not accept projects it finds morally questionable, unethical, or
distasteful.

Permission
Your design may be selected for use in the Uniquehorn Designs portfolio. If chosen, a screenshot of your final
design will be shown. If the design is a blog design, it may be also linked to your blog’s URL unless you specifically
note otherwise.

Cross-Browser Compatibility
Uniquehorn Designs creates to meet the standards that comply with the latest browser versions and is not
responsible for inconsistencies that may appear when older browser versions are used. Any site created will be
viewable in current versions of Microsoft Internet Explorer, Mozilla Firefox, and Safari, Chrome and/or Opera. We
cannot guarantee error-free viewing in any browser that includes third-party plug-ins.

Compatibility is defined herein as all critical elements of each page being viewable in these browsers. Client is
aware that some internet technologies may require a more recent browser version, operating system, or plug-in.

Liability
Any service purchased from Uniquehorn Designs is provided ‘as is’ without warranty of any kind that the web
design project will be uninterrupted or error-free. In no event will Uniquehorn Designs be liable to you or any third
party, on any legal theory for any direct, indirect, special, incidental, punitive, exemplary or consequential damages
arising out of the use of any Uniquehorn Designs service, graphic or code, or the use of any hosting service, service
provider, telecommunications carrier, internet servers, third party e-commerce programs, or your site visitor’s
computer or internet software, including, without limitation, service interruptions caused by Acts of God and/or
Nature, or any other circumstances beyond our reasonable control, any lost profits, business interruption, loss of data
or otherwise, even if expressly advised of the possibility of such damages.

Uniquehorn Designs will make no warranty to cover old browsers or requested special effects that have been
advised against.

Uniquehorn Designs will not be held responsible for any lost images or links to images from a previous design upon
the installation of the design to your blog.

Notice: This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon.
Exclusive jurisdiction and venue is as governed in the district court of Portland, OR.

By contacting Uniquehorn Designs for a consultation you are agreeing to these Terms and Conditions.

These Terms and Conditions supersede all previous representations, understandings or agreements. Terms are
subject to change.
